Welcome to LearningYard. These Terms of Service ("Terms") govern your access to and use of the LearningYard platform, including our website and services for discovering, enrolling in, and teaching live online classes. By creating an account or using our services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our platform.

1. Acceptance and Eligibility

By using LearningYard, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the authority to agree to these Terms. If you are using the platform on behalf of a minor (e.g., as a parent or guardian), you accept these Terms on their behalf and are responsible for their use of the platform in accordance with these Terms.

2. Account Registration and Security

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the platform or other users.

3. Use of the Platform

You may use LearningYard to browse and discover classes, enroll learners (including minors under your care), attend or facilitate live online classes, and use related features (e.g., messaging, scheduling). You agree to use the platform only for lawful purposes and in accordance with these Terms. You must not:

• Violate any applicable law or regulation.
• Infringe the intellectual property or other rights of others.
• Harass, abuse, or harm other users, instructors, or staff.
• Transmit malware, spam, or any content that is harmful or inappropriate.
• Attempt to gain unauthorized access to our systems or other accounts.
• Use the platform for any purpose that competes with or undermines LearningYard.

We reserve the right to remove content or suspend access that we determine violates these Terms or is otherwise harmful.

4. Classes, Enrollments, and Conduct

Class content, scheduling, and conduct standards are set by instructors and by LearningYard policies. By enrolling in a class, you agree to comply with the instructor's rules and our community guidelines. Parents and guardians are responsible for ensuring that minors under their care are supervised as appropriate and behave appropriately during live sessions. We are not responsible for the content of third-party instructors beyond our content and conduct policies.

5. Payments and Refunds

Fees for classes are displayed at the time of enrollment. You agree to pay all applicable fees when you complete a purchase. Payments are processed by our designated payment provider (e.g., Stripe). Refund and cancellation policies may vary by course or instructor and will be disclosed at checkout or in the course description. LearningYard may facilitate refunds in accordance with our refund policy and the instructor's policy. Chargebacks or disputed payments may result in account suspension until resolved.

6. Intellectual Property

LearningYard and its licensors own all rights in the platform, including the design, branding, and underlying technology. Instructors retain rights in their course content; by publishing on LearningYard, they grant us a license to host, display, and promote that content in connection with the platform. You may not copy, modify, or distribute our platform or content without our written permission.

7. Disclaimers

The platform and services are provided "as is" and "as available." We disclaim all warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted or error-free access, and we are not responsible for the quality, accuracy, or legality of instructor-provided content or conduct outside our stated policies.

8. Limitation of Liability

To the maximum extent permitted by law, LearningYard and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the platform. Our total liability for any claims related to the platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain limitations; in such cases, our liability will be limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless LearningYard and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

10. Termination

You may close your account at any time through your account settings or by contacting us. We may suspend or terminate your access to the platform at any time for violation of these Terms or for any other reason we deem necessary. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will survive termination.

11. Disputes and Governing Law

These Terms are governed by the laws of the jurisdiction in which LearningYard operates, without regard to conflict of law principles. Any dispute arising from these Terms or the platform shall be resolved in the courts of that jurisdiction, except where prohibited. You may also have rights under consumer protection laws in your country.

12. Changes to the Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we may notify you by email or through the platform. Your continued use of the platform after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the platform.
